Terms & Conditions (E-Commerce – Clothing)

This document is a general template for a UK/EU e-commerce fashion store.


 

1) Who we are

2) Scope of these Terms

These Terms govern your use of [brand.com] (the “Site”) and the purchase of products (“Products”). By using the Site or placing an order, you agree to these Terms and our Privacy Notice and Cookie Policy.

3) Eligibility

You must be at least 18 years old and a consumer (not purchasing primarily for resale) to buy from us.

4) Account & Security

You may check out as a guest or create an account. You’re responsible for keeping your login details confidential and for all activity under your account. We may suspend or close accounts for misuse, fraud, or breach of these Terms.

5) Ordering Process

ï Placing an order: Add items to cart and complete checkout. You may review and correct errors before paying.

ï Order acknowledgement: We’ll email an order confirmation. This confirms receipt, not acceptance.

ï Acceptance & contract: The contract is formed when we dispatch the Products and send a dispatch email.

ï Pre-orders / made-to-order: Lead times will be shown at checkout. Dates are estimates. See Returns for special rules.

6) Pricing & Payment

ï Prices are shown in [currency] and [inclusive/exclusive] of VAT as indicated.

ï Shipping, duties, and taxes (if any) are shown at checkout.

ï We accept [cards, PayPal, Klarna, etc.]. Payment is taken [on order/at dispatch].

ï We may refuse an order (e.g., product unavailable, pricing error, failed payment checks). If payment was taken, we’ll refund it.

7) Discount Codes & Promotions

One code per order unless stated. Non-transferable, not redeemable for cash, and subject to expiry dates and exclusions (e.g., sale items). We may withdraw or modify promotions at any time.

8) Product Information, Sizing & Colours

We aim for accuracy, but minor variations may occur (e.g., colour differences due to screen settings). Please consult our Size Guide and Care Guide. This doesn’t affect your statutory rights if an item is misdescribed.

9) Shipping & Delivery

ï Destinations: We ship to [list of countries/regions].

ï Timescales: Estimated delivery windows are shown at checkout. Dispatch & delivery times are not guaranteed.

ï Risk & title: Risk passes on delivery. Title passes when we receive full payment.

ï Missed delivery: If a parcel is returned to us after failed delivery attempts, we may recharge shipping for re-dispatch.

ï International orders: You’re responsible for import duties/taxes and customs clearance, unless stated otherwise.

10) Your Right to Cancel (UK/EU Consumers)

ï Cooling-off period: For most items bought online, you have 14 days from delivery to cancel without giving any reason.

ï How to cancel: Inform us before the 14-day period ends (see Model Cancellation Form below or email us). You then have 14 days to return the items.

ï Refunds: We’ll refund the product price and the standard outbound shipping cost within 14 days of receiving the return (or proof of posting), to your original payment method.

ï Deductions: We may deduct for any loss in value resulting from handling beyond what’s necessary to establish the nature, characteristics and functioning of the goods (e.g., worn/washed items, removed tags).

Exceptions to Cancellation

You cannot cancel/return (unless faulty):

ï Sealed goods not suitable for return due to health protection or hygiene reasons once unsealed (e.g., underwear, swimwear, socks if packaging hygiene seal is broken).

ï Personalised, monogrammed, altered, or made-to-order items.

ï Items that are mixed inseparably with other goods after delivery.

11) Our Returns & Exchanges Policy (in addition to your statutory rights)

ï Return window: [e.g., 30 days] from delivery for a refund or [e.g., 30–45 days] for store credit/exchange (if offered).

ï Condition: Items must be unworn, unwashed, with all tags and packaging. Footwear must be tried on indoors.

ï Process: Start your return via [returns portal/email], include your order number, and use the provided label (if applicable).

ï Costs: [Free returns in UK / return postage deducted / customer pays return postage] unless the item is faulty or we sent the wrong item.

ï Exchanges: Subject to stock. If unavailable, we’ll refund or issue store credit.

ï Bundles / gifts: Partial returns may affect bundle pricing or free gifts; we may deduct the value of kept items/gifts.

12) Faulty or Misdescribed Items

If your item is faulty or not as described, contact us promptly with photos. You may be entitled to a repair, replacement, or refund under consumer law (e.g., short-term right to reject within 30 days in the UK). This is separate from change-of-mind returns.

13) Gift Cards & Store Credit

ï Gift cards are non-refundable, non-transferable, and valid for [e.g., 24 months] from purchase unless mandated otherwise by law.

ï Treat as cash; lost or stolen cards will not be replaced.

ï Store credit expires [e.g., 12 months] from issuance.

14) Personalised / Made-to-Order Items

Production begins shortly after purchase. Lead times are estimates. These items are non-cancellable and non-returnable unless faulty.

15) User Content (Reviews, Photos, Social Tags)

By posting or sharing content with us (e.g., reviews or social posts tagging #[BrandName]), you grant [Brand Name] a worldwide, royalty-free licence to use, reproduce, and display that content for marketing purposes, subject to our Privacy Notice. We may moderate or remove content at our discretion.

16) Intellectual Property

All content on the Site (logos, graphics, designs, photos, copy) is owned by or licensed to [Brand Name] and protected by IP laws. You may not use our IP without prior written consent.

17) Acceptable Use

You agree not to: (a) misuse the Site; (b) attempt to gain unauthorised access; (c) upload malware or harmful code; (d) use the Site for unlawful purposes; (e) engage in scraping, automated data collection, or bulk purchasing for resale without our consent.

18) Resale & Purchasing Limits

We may limit quantities per customer/household or cancel orders that appear to be placed by resellers, dealers, or distributors without prior written approval.

19) Privacy & Cookies

Please see our Privacy Notice and Cookie Policy for details on how we process personal data under UK GDPR / EU GDPR and your rights. If we rely on fraud-prevention checks or credit/BNPL partners, their privacy terms also apply.

20) Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot be limited or excluded by law.
We’re not responsible for: (a) losses not caused by our breach; (b) business losses (including loss of profits, revenue, contracts, data, goodwill); or (c) delays outside our reasonable control. Your statutory rights remain unaffected.

21) Force Majeure

We’re not liable for delays or failures caused by events beyond our reasonable control (e.g., strikes, extreme weather, transport interruptions, epidemics, war, government actions).

22) Third-Party Services

If you choose third-party payment or delivery options, their terms may apply.

23) Complaints & Dispute Resolution

We aim to resolve issues quickly. Please contact loveaholic.info@gmail.com If you are in the EU, you may—if applicable—use the EU Online Dispute Resolution platform.

24) Changes to these Terms

We may update these Terms from time to time. The version posted at the time you place an order will apply to that order.

25) Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Courts of England and Wales shall have non-exclusive jurisdiction (consumers may also bring claims in their local court within the UK/EU as permitted by law).
